Technology has brought the world to our fingertips with use of the Internet and the myriad of devices in which to access the Internet. With some clever Googling, you can find almost anything you can imagine. You may even know a friend or acquaintance that regularly downloads new movies or music for free. This sounds really great, but is it legal?

Nine times out of 10, downloading free music and movies, especially via BitTorrent, is illegal. That acquaintance who is downloading the latest movies and adding to his music library for free is probably breaking the law. One should always assume that any movie or music that is not made free to you by a recording or publishing company is not legal.

The Digital Millennium Copyright Act (DMCA) permits copyright owners to notify Emery Telcom if they believe that an Emery customer has infringed their work(s). When Emery receives a notice from a copyright owner or its authorized agent, Emery will notify the identified customer of the alleged infringement by providing them a copy of the notice. As required by law, Emery may determine that the customer is a repeat copyright infringer and reserves the right to suspend or terminate the accounts of repeat copyright infringers.

It is possible that this activity could occur in your home or business without your permission or knowledge by an unauthorized user, a minor who may not fully understand the copyright laws or even as a result of a computer virus. However, the named subscriber on the account may be held responsible for any misuse of said account.

Internet customers should be aware that using Emery’s service to engage in any form of copyright infringement is expressly prohibited by Emery’s Terms of Use Policy and that repeat copyright infringement, or violations of any other Emery policy, may result in the suspension, disconnection and/or termination of service.
